1. Age Restriction – 18+ Only
It is illegal to sell tobacco products to persons under 18 in the United Kingdom.
By placing an order, you confirm that:
- You are at least 18 years old
- The recipient of the goods is at least 18 years old
We operate electronic age verification checks and reserve the right to:
- Request photographic identification
- Delay dispatch pending verification
- Cancel orders where age cannot be verified
Deliveries sent via Royal Mail or Parcelforce may require age verification on delivery. Failure to successfully complete age verification may result in the parcel being returned and fees deducted (see Section 8).
2. Regulatory Compliance
All tobacco products are supplied in compliance with the Tobacco and Related Products Regulations 2016.
Products are sold for personal consumption only and not for resale.
3. Order Acceptance & Contract Formation
- An order confirmation email acknowledges receipt only.
- A legally binding contract is formed only when goods are dispatched.
- We reserve the right to cancel orders before dispatch for legitimate reasons including stock errors, pricing errors, regulatory concerns, or suspected fraud.
4. Pricing & Payment
- All prices include VAT where applicable.
- Payment must be received in cleared funds before dispatch.
- We reserve the right to amend pricing at any time prior to dispatch.
5. Delivery (UK Mainland Only)
We ship to UK mainland addresses only unless agreed otherwise in writing.
Orders are dispatched via Royal Mail or Parcelforce Worldwide.
Delivery timeframes are estimates and are not guaranteed.
Under the Consumer Rights Act 2015, goods remain our responsibility until delivered to the address provided.
If you provide:
- “Safe place” instructions
- Authority to leave
- Delivery redirection
delivery will be deemed complete once the parcel is left in accordance with those instructions.
We are not responsible for delays caused by:
- Courier operational issues
- Severe weather
- Industrial action
- Events outside our reasonable control
6. Year-Round Shipping & Temperature Disclaimer
We ship year-round, including during winter and summer temperature extremes.
Cigars are natural products and may be affected by cold or heat during transit.
We take reasonable steps to protect goods, including appropriate packaging. However:
- Minor wrapper cracking due to temporary cold shock
- Slight dryness that resolves after proper re-humidification
- Natural plume or oil spotting
do not automatically constitute defects.
Once delivered, responsibility for proper storage passes to the customer.
7. Damaged Goods in Transit (Royal Mail / Parcelforce Claims Alignment)
Because courier claims require prompt evidence, strict reporting timelines apply.
7.1 Reporting Deadline
You must notify us within 48 hours of confirmed delivery.
Claims submitted after 48 hours may be rejected where this prevents us from pursuing a courier claim.
7.2 Required Evidence
Email sales@c-gar.uk with:
- Order number
- Clear photographs of:
- Outer box (showing condition upon arrival)
- Internal packaging
- Shipping label
- Damaged items (clear close-ups)
- Description of damage
Do not dispose of packaging until the claim is resolved.
7.3 Resolution
If damage is verified as occurring in transit, we may at our discretion:
- Replace affected items
- Offer store credit
- Issue a refund
We may require return of goods before resolution.
We are not responsible for:
- Damage occurring after delivery
- Packages left outside for prolonged periods
- Improper storage after receipt
Your statutory rights remain unaffected.
8. Failed Delivery / Returned Parcels
If a parcel is returned due to:
- Failed age verification
- No one available to accept delivery
- Incorrect address provided by the customer
- Refusal of delivery
We reserve the right to deduct:
- Original outbound postage
- Return postage charged by Royal Mail or Parcelforce
- Payment processing fees
from any refund issued.
If returned goods are deemed unsellable due to environmental exposure or compromised condition, we reserve the right to refuse refund.
9. 14-Day Consumer Cancellation Rights
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you may cancel your order within 14 days of receiving goods.
However:
9.1 Sealed Tobacco Exception
The right to cancel is lost if sealed tobacco products are opened or unsealed due to health protection and hygiene reasons.
9.2 Return Conditions
To cancel:
- Notify us in writing within 14 days of delivery
- Return goods within 14 days of cancellation
- Goods must remain sealed, unopened, and unused
You are responsible for return postage.
We may reduce the refund if goods show handling beyond what is necessary to inspect them.
Refunds are processed within 14 days of receiving returned goods.
10. Faulty Goods
Under the Consumer Rights Act 2015:
- Within 30 days of delivery, you may reject faulty goods for a full refund.
- After 30 days, we may offer repair or replacement in the first instance.
All alleged faults are subject to inspection.
Natural variation in handmade cigars does not automatically constitute fault.
11. Storage Responsibility
Cigars should be stored at appropriate humidity levels (typically 62–72% RH).
We are not responsible for deterioration once:
- Delivered
- Left in direct sunlight
- Stored outside a humidor
- Exposed to extreme temperatures after delivery
12. Fraud & Chargebacks
We actively monitor for fraudulent activity.
In the event of unjustified chargebacks, we may submit:
- Proof of delivery
- Age verification confirmation
- Order and dispatch records
to payment processors and pursue recovery where appropriate.
Accounts may be permanently restricted.
13. Limitation of Liability
Nothing in these Terms limits liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any rights under UK consumer law
Subject to this, our liability shall not exceed the total order value.
14. Governing Law
These Terms are governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction.
